1. Who is responsible for your information?

Process Equipment Specialists SA (Pty) Ltd, trading as Process Equip, is the responsible party for personal information we process through this website and our business enquiry channels. Registration number: 2020/440257/07. VAT number: 4490291459. Our physical and postal address is 30 Marconi Road, Montague Gardens, Cape Town, 7441, South Africa.

Our Information Officer is Tony Johannes Kilian. Contact [email protected] or +27 82 461 9347 for privacy questions, requests or objections.

2. What we collect and where it comes from

When you contact us through a form, email, telephone or WhatsApp, request a quotation, offer equipment for sale or place an order, we collect the information you provide. This may include your name, company, role, telephone number, email address, delivery address, equipment specifications, photographs, enquiry, quotation, order and correspondence details. We may receive related business information from a person acting for your organisation, an equipment seller or a supplier involved in your request.

Our website and its service providers may also collect technical information such as IP address, browser and device details, pages visited, referring pages, cookies and security logs. See section 7 for website technologies and third-party services. Please do not send identity documents, banking details or sensitive personal information through the general enquiry form unless we specifically request them through an appropriate channel.

3. Why we process information and the lawful grounds

We use information to respond to enquiries; assess equipment requirements; prepare quotations; arrange equipment listings and sales; fulfil and support orders; manage suppliers; keep business, accounting and tax records; and protect our website and systems. Depending on the purpose, processing is based on steps requested before a contract or performance of a contract, a legal obligation, legitimate interests in operating and securing our business where permitted by POPIA, or your consent where required. Applicable record-keeping obligations include company and tax legislation.

4. Required and optional information

You choose whether to make an enquiry. Fields marked with an asterisk are required by the relevant online form; other fields are optional. If you do not provide the details needed to identify your request and contact you, we may be unable to submit the form, respond, prepare a quotation or fulfil an order. You may use the email or telephone contact details above if you prefer another enquiry channel.

5. Sharing information and international transfers

We do not sell or rent your personal information. We disclose relevant information only where needed for the stated purposes, including to equipment suppliers and manufacturers, couriers and freight agents, accountants and auditors, banks, IT and hosting providers, email and business communication providers, and public authorities where legally required.

Some providers and overseas equipment suppliers may process information outside South Africa. Transfers must satisfy section 72 of POPIA, for example through an adequate level of legal or contractual protection, your consent where applicable, or a qualifying contractual necessity. You may ask the Information Officer for details about the recipients, countries and safeguards relevant to your information.

6. Retention and security

We retain information for as long as reasonably needed for the purpose for which it was collected, to deal with the resulting business relationship or dispute, or to meet applicable legal record-keeping requirements. Information no longer needed is deleted, destroyed or de-identified, subject to lawful retention requirements.

We use reasonable technical and organisational safeguards, including password-protected systems, access restrictions and backups. No website, email or messaging service can guarantee absolute security. If a security compromise occurs, we will assess and meet the notification obligations applicable under POPIA.

7. Cookies, analytics and external services

Cookies and similar technologies may support website functions, security, enquiry or catalogue features, usage measurement and marketing. Website pages include or reference services such as Google Analytics, marketing-automation scripts, ShareThis sharing tools, Cloudflare, WooCommerce and email/newsletter services. The information these services receive can include technical identifiers and browsing activity; loading third-party content may disclose your IP address to the provider.

Some pages include Google Maps or video content. Links to WhatsApp, Facebook, Instagram, LinkedIn and YouTube take you to services governed by their own privacy notices. Where third-party content is embedded, its provider may receive information when the content loads, even if you do not interact with it. You can contact us directly by telephone or email instead.

You can manage or delete cookies through your browser settings; blocking cookies may affect some site functions. Consent must be obtained before processing that requires it. This notice does not itself obtain consent, and submitting an equipment enquiry does not constitute consent to optional tracking or marketing.

8. Marketing choices

Submitting an enquiry does not subscribe you to marketing. Under our stated opt-in policy, we send promotional email or WhatsApp messages only when you have agreed to receive them. You may withdraw that consent or object to marketing at any time by using the unsubscribe option supplied or contacting [email protected]. Withdrawing marketing consent does not prevent us from responding to an enquiry or sending necessary order and service communications.

9. Your rights

Subject to the applicable law, you may ask whether we hold your personal information, request access to it, request correction or deletion of inaccurate or unlawfully held information, object to processing on the grounds available under POPIA, or withdraw consent for processing based on consent. Rights to deletion and objection are subject to lawful retention and other statutory requirements. We may request proportionate proof of identity before disclosing or changing information. Contact the Information Officer using the details above.

10. Complaints and access to records

If you are dissatisfied with our handling of your personal information, you may complain to the Information Regulator (South Africa): inforegulator.org.za; [email protected]; telephone 010 023 5200. The Regulator’s website provides current complaint procedures and forms.

Read our PAIA Manual for the records we hold and the procedure for requesting access. We will update this notice when our details or processing practices change.
